Welcome to the online platform operated by QPQ IaaS AG (Allmeindstrasse 17, 8840 Einsiedeln, Switzerland; CHE-242.519.378). Our online platform includes www.gajumining.com, our social media pages (including LinkedIn, X, YouTube, Rumble, Facebook, Instagram, and Discord), and any other digital platforms operated by us (collectively, the “Online Platform”).
These Terms of Use (“Terms”) govern your access to and use of the Online Platform. By accessing or using the Online Platform, you agree to these Terms. If you do not agree, you must not use the Online Platform.
1. Eligibility
By accessing or using the Online Platform, you confirm that you are at least 18 years old (or of legal age in your jurisdiction) and have the legal capacity to enter into these Terms.
The Online Platform is not directed at children under 16. We do not knowingly provide services to anyone under 16 years of age.
2. Your Account
If you create an account on the Online Platform, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If we suspend or terminate your account, we will notify you by email where reasonably practicable and explain the reason, unless prohibited by law.

Accessing or using the Online Platform does not grant you any rights or licences to our trademarks, logos, or other proprietary marks.
5. User Conduct

We do not warrant that the Online Platform will be uninterrupted, error-free, or free of viruses or other harmful components, nor that any information is complete, accurate, or up to date. Information is subject to change without notice.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
8. Limitation of Liability
To the maximum extent permitted by applicable law, QPQ IaaS AG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Online Platform.
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under Swiss law, including liability for intentional misconduct and gross negligence (Art. 100(1) CO).

11. Changes to These Terms
QPQ IaaS AG reserves the right to modify these Terms at any time. When we make material changes, we will post a prominent notice on the Online Platform and update the “Last Updated” date at the top. Material changes will take effect 30 days after posting unless a longer period is required by law. Your continued use of the Online Platform after changes take effect constitutes your acceptance of the updated Terms.
If you do not agree with any changes, you should stop using the Online Platform.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at the registered seat of QPQ IaaS AG (currently Einsiedeln, Canton of Schwyz), subject to any mandatory statutory provisions granting jurisdiction to the courts at the consumer’s domicile.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the original intent.
14. Force Majeure
QPQ IaaS AG shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, or internet disruptions.
